You are modifying a flight control, read the definition of a major repair or alteration,
FAR 43 appendix A (1) and (XIII), also read SM35 on rigging, paragraph 13.

Just because you have seen it on other planes, does not make it legal, just means someone did not take the time to do the job right. I had a friend with a 172 that had yawing/wing heavy condition, a mechanic put a tab on the rudder to "correct" the issue, and it was there for years, and of course, no logbook entry. I removed the tab, and then turned the cam on the rear spar of the right wing, problem was solved, all by changing the washout of the wing.

There was an SB recommending the removal of the aileron trim tabs but there was no AD so I assume they are legal.

Matt, can you post a reference to support this?
These tabs have been on this plane a long time and have passed every annual performed by many different IAs.
